Overview

Welcome to MYTOOGO at https://mytoogo.com (the “Store”).

The Store is operated by RICH SOIL SUPPLY CHAIN CO., LIMITED, a Hong Kong company (“MYTOOGO”, “we”, “our” or “us”).

We offer creative building gifts, surprise calendars, miniature toys and collectibles (the “Products”), together with our website and related customer services (collectively, the “Services”).

The Store is powered by Shopify, which provides ecommerce technology; your contract for Products is with our operating company, not Shopify.

Please review these Terms of Service and our Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy.

By using the website, you agree to the website-use provisions below. Any purchase is governed by the terms disclosed at or before checkout and any mandatory legal rights that apply.

Nothing in these Terms excludes consumer protections that cannot legally be waived.

1. Access and Account

You must be legally able to place an order, or obtain permission from a parent or legal guardian where required.

Keep your account sign-in details secure, and provide accurate and up-to-date contact, payment and delivery information.

Let us know if you believe your account has been used without authorisation. You must not use another person’s account without permission.

2. Our Products

MYTOOGO focuses on creative gifts, Advent and surprise calendars, mini collectibles and hands-on building products.

Please read each product listing for what is included, options, dimensions, age guidance and any specific warnings.

Contents vary by product: a miniature-toy calendar is not necessarily a building set, and a building calendar is not necessarily a ready-made toy.

Product photographs are intended to describe the actual item, although screen settings and manufacturing batches may produce reasonable differences in appearance.

We will not knowingly substitute materially different goods without addressing your legal rights.

Small parts may be unsuitable for young children; review the packaging and our Product Safety & Care guidance.

Online illustrations of our “Build Your Own Gift Box” show selections made on the website. A physical gift box, wrapping or handwritten card is included only when expressly stated on the relevant product listing or order confirmation.

We may update our catalogue and availability; changes will not remove your rights in an order already accepted.

3. Orders

Submitting an order is an offer to buy the selected Products at the checkout total.

We may accept the order by confirming it and arranging fulfilment, subject to successful payment, stock or supplier availability, delivery restrictions and any necessary fraud checks.

We will contact you if we cannot fulfil an order or need to resolve a material error. Where payment was taken and we cannot fulfil an order, we will arrange the refund due.

Check product quantities, destination and contact information before confirming.

For changes or cancellations, contact us promptly through our Contact Us page.

We may be unable to intercept a parcel that has already shipped; any statutory cancellation or product-quality rights remain unaffected.

Our Returns & Refunds Policy explains voluntary returns and mandatory legal remedies.

Non-defective goods that have been opened and then used, played with or assembled are not eligible for voluntary change-of-mind returns, except as required by law.

Where UK or other statutory withdrawal rights apply, opening packaging or reasonably inspecting goods does not itself cancel those rights; lawful deductions for use beyond reasonable inspection may apply.

4. Prices, Currency and Billing

Prices may be displayed in USD, GBP or AUD according to your selected market.

The final item prices, currency, discounts, shipping charges and any taxes collected by the Store are displayed at checkout before payment.

Prices and promotions may change for future orders, but not retrospectively for accepted orders except where applicable law permits correction and appropriate remedies.

Automatic quantity discounts apply only to eligible Products and according to the conditions shown at checkout.

Promotional codes, including WELCOME10 when available, are subject to their displayed eligibility, duration, usage and combination rules.

A digital gift-box preview does not alter the Products you receive.

Customs duties, import taxes and carrier handling fees may be payable depending on the destination and delivery terms.

We will disclose the information we are legally required to provide before checkout.

Do not pay unexpected third-party requests without checking them with the carrier or our support team.

You confirm that you are authorised to use your chosen payment method.

Payment processing may be carried out by Shopify Payments or another displayed payment provider.

5. Shipping and Delivery

We generally aim to prepare paid orders for dispatch in 1–3 business days.

Carrier transit begins after dispatch and depends on the delivery country, postal code, selected service, customs processing and seasonal conditions.

Any estimated transit time is not a guaranteed delivery date unless we expressly agree to a specific commitment.

We remain responsible for delivering goods as required by applicable consumer law.

Where the law provides that risk remains with the seller until goods reach you or your designated recipient, handing a parcel to our courier does not transfer that risk to you.

If a parcel is lost, delivered to the wrong place or materially delayed, please contact us so we can investigate and provide the remedy required by law.

We are not responsible for circumstances genuinely outside our reasonable control to the extent permitted by law, but this does not remove your statutory rights concerning delayed or undelivered goods.

6. Intellectual Property

Our website text, branding, layout, photographs, graphics and other material are owned by MYTOOGO or used with the permission of their respective rights holders.

Product manufacturers and third parties retain their own intellectual property.

You may use website content for personal shopping purposes only; commercial copying, republication or misuse requires the relevant rights holder’s permission.

Purchasing a Product does not transfer rights in its original artwork, design, software or branding.

7. Optional Tools and Features

We may provide optional features such as product recommendations, a gift-selection quiz, a virtual Advent activity or third-party customer tools.

These features are offered to help you browse and choose gifts.

Their illustrations or recommendations do not replace the final product description or checkout details.

Third-party features may also have their own terms and privacy notices.

8. Third-Party Links

The Store may link to websites and services operated by others.

Please review the relevant third party’s conditions and privacy notices when leaving our site.

We are not responsible for independent third-party content, except where applicable law imposes responsibility on us.

9. Relationship with Shopify

Shopify supplies ecommerce infrastructure for the Store and may process information needed to operate it.

The sale of Products is between the customer and RICH SOIL SUPPLY CHAIN CO., LIMITED.

Shopify is not the merchant selling the Products.

Your consumer rights against the seller remain unaffected.

10. Privacy Policy

Our Privacy Policy describes collection, use and disclosure of personal information, including where Shopify and service providers process data to operate checkout, provide customer service, analyse website activity and prevent fraud.

Where legally required, we will request consent for cookies or marketing communications.

Privacy rights and requests are handled according to applicable law.

11. Reviews, Photographs and Feedback

If you voluntarily submit a review, photo, comment or suggestion, you confirm that it is your own content or that you have permission to share it.

You give MYTOOGO a non-exclusive, worldwide, royalty-free licence to display and use that material in connection with operating and promoting the Store, subject to applicable privacy, advertising and intellectual-property laws.

We may moderate unlawful, misleading, abusive or infringing content.

We do not require customers to provide positive reviews or misrepresent sponsored content as independent customer feedback.

12. Errors and Inaccuracies

Occasionally a listing, promotion or delivery description may contain an error.

We may correct mistakes and inform affected customers.

If an error prevents us from accepting or fulfilling an order, we will notify you and provide any refund or other remedy required by law.

We will not change an accepted order without lawful justification.

13. Prohibited Uses

You must not use the website unlawfully, interfere with its security, attempt fraudulent transactions, upload malware, infringe intellectual-property rights, harass others, scrape personal data without lawful authority or use the Services to mislead customers.

We may restrict abusive activity where reasonable and lawful, without affecting legitimate customer claims or remedies.

14. Automated Tools and Agents

If you use automated software or an AI shopping agent to access the website, it must comply with applicable law and the website’s reasonable security and access controls.

Automated tools must not conceal activity to circumvent access restrictions, submit deceptive orders, bypass security measures or misuse customer data.

Nothing in this section restricts legally protected activities or rights.

15. Suspension or Termination

We may limit website account access for suspected fraud, security threats or serious breaches of these Terms, where reasonable and lawful.

Any accepted orders, valid refunds, consumer guarantees, privacy rights and other obligations that must survive remain enforceable.

16. Warranties and Consumer Guarantees

Website availability and optional features may occasionally be interrupted.

We do not guarantee uninterrupted website access.

We do not exclude or limit statutory warranties, remedies or consumer guarantees for Products.

In particular, Australian consumers have rights under the Australian Consumer Law, and UK consumers have applicable statutory rights concerning goods, delivery and cancellation.

Where consumer rights apply, they prevail over inconsistent wording in these Terms.

17. Limitation of Liability

To the extent the law permits, we are not responsible for losses that were not reasonably foreseeable or that arise solely from misuse of the Services unrelated to a failure by us.

Nothing here excludes or limits liability for fraud, death or personal injury caused by negligence where prohibited, defective or non-conforming Products, or any consumer protection or other liability that cannot lawfully be excluded.

Any enforceable limitation will be interpreted only to the extent permitted by the law that applies to your claim.

18. Responsibility for Misuse

You may be responsible for losses arising from your unlawful use of the Store or deliberate infringement of another person’s rights, to the extent permitted by law.

This clause does not require ordinary consumers to waive legal rights or to reimburse us merely for bringing a legitimate complaint.

19. Severability

If any provision is unenforceable, the remainder continues to apply where legally permissible.

Any mandatory consumer right prevails over a conflicting provision.

20. Entire Agreement and Waiver

These Terms, the terms displayed at checkout, and the policies expressly referenced here govern your use of the Store and your purchases, subject to mandatory legal rights.

Failure to enforce a provision on one occasion does not automatically waive it on another occasion.

21. Assignment

We may reorganise our business or transfer contractual responsibilities where lawful, provided this does not reduce rights that cannot be taken away, and we give any notice required by law.

You may not transfer account access to another person without permission.

22. Governing Law and Disputes

Subject to mandatory laws that protect consumers where they live, these Terms are governed by the laws of Hong Kong.

Nothing in this clause deprives a consumer of applicable mandatory rights or lawful access to courts or dispute-resolution mechanisms available in their jurisdiction.

23. Languages and Translations

These Terms are provided in English and may be translated.

If translations differ, we may use the English version to interpret the intended wording, except where mandatory local law requires otherwise.

Consumers retain rights under applicable law regardless of language.

Headings are for convenience and do not change the interpretation of these Terms.

25. Electronic Communications

We may email you regarding orders, payment, dispatch, returns, account security and changes affecting our Services.

Promotional email is sent only where legally permitted and subject to applicable consent and unsubscribe requirements.

We may update these Terms from time to time and will indicate the latest revision date.

Where legally required, we will notify customers of material changes.

The terms applicable to a purchase are generally those presented when the order was placed, subject to mandatory law and any lawful agreement to later changes.
